Terms & Conditions

By accessing, browsing, or using the Seeken AI platform (the "Platform"), including its website, mobile applications, AI-powered tools, and any associated services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms"). If you do not agree with any provision of these Terms, you must immediately cease all use of the Platform.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Seeken AI ("Company", "we", "us", or "our"), operated under the laws of the United Arab Emirates (UAE). By using this Platform, you confirm that you are at least 13 years of age, or have obtained verifiable parental or guardian consent where required by applicable law.

• "Platform" refers to the Seeken AI website, applications, AI tools, and all related digital services.
• "Content" means all text, images, data, code, AI-generated responses, educational materials, and any other information available through the Platform.
• "User Content" means any data, text, prompts, files, or information submitted by users to the Platform.
• "Prohibited Activities" include fraud, hacking, phishing, unauthorized access, data scraping, and any activity that violates these Terms or applicable law.
• "Personal Data" means any information relating to an identified or identifiable natural person, as defined under UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL).

Seeken AI provides AI-powered educational tools and resources. You agree to use the Platform solely for lawful, legitimate, and educational purposes in accordance with these Terms and all applicable UAE federal and local laws, including but not limited to:

• UAE Federal Decree-Law No. 34 of 2021 on Combating Rumours and Cybercrimes
• UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL)
• UAE Federal Law No. 2 of 2019 on the Use of ICT in Health Fields (as applicable to AI-generated educational health content)
• UAE Penal Code (Federal Law No. 3 of 1987, as amended)
• Telecommunications and Digital Government Regulatory Authority (TDRA) regulations

You are strictly prohibited from engaging in, attempting, or facilitating any of the following activities. Violation may result in immediate account termination, legal action, and reporting to UAE authorities:

4.1 Fraud & Deception

• Providing false, misleading, or fraudulent information during registration or use of the Platform
• Impersonating any person, entity, or Seeken AI representative
• Using the Platform for financial fraud, identity theft, or any deceptive scheme
• Creating fake accounts or using multiple accounts to circumvent restrictions
• Manipulating AI responses or outputs for fraudulent purposes

4.2 Hacking & Unauthorized Access

• Attempting to gain unauthorized access to the Platform, its servers, databases, or any connected systems
• Circumventing, disabling, or interfering with security features, authentication mechanisms, or access controls
• Deploying or distributing malware, viruses, trojans, ransomware, spyware, or any malicious code
• Conducting vulnerability scanning, penetration testing, or security assessments without prior written authorization
• Exploiting software bugs, glitches, or vulnerabilities for unauthorized advantage
• Performing SQL injection, cross-site scripting (XSS), cross-site request forgery (CSRF), or any other form of code injection attack
• Reverse engineering, decompiling, or disassembling any part of the Platform software
• Using automated bots, scrapers, crawlers, or similar tools to access or collect data from the Platform without permission

4.3 Phishing & Social Engineering

• Sending or distributing phishing emails, messages, or communications that impersonate Seeken AI
• Creating fraudulent websites, apps, or landing pages that mimic the Platform's appearance
• Attempting to obtain user credentials, personal data, or financial information through deception
• Social engineering attacks targeting Seeken AI users, staff, or partners
• Using the Platform to distribute phishing links or fraudulent content to other users

4.4 Data & Privacy Violations

• Collecting, harvesting, or storing personal data of other users without their explicit consent
• Unauthorized access to, disclosure of, or misuse of any user's personal information
• Using the Platform to process, store, or transmit data in violation of UAE PDPL or other data protection laws
• Sharing, selling, or distributing user data obtained through the Platform

4.5 Service Disruption

• Conducting denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
• Overloading, flooding, or spamming the Platform or its infrastructure
• Interfering with the proper functioning of the Platform or other users' experience
• Attempting to crash, slow down, or degrade the performance of the Platform

4.6 Content Violations

• Uploading, transmitting, or distributing content that is illegal, harmful, defamatory, obscene, or offensive under UAE law
• Content that promotes hatred, discrimination, terrorism, or violence
• Content that violates intellectual property rights, copyrights, trademarks, or patents of any third party
• Content that violates UAE public morals, values, or religious sensitivities
• Using AI tools to generate prohibited, harmful, or illegal content

All content, branding, logos, designs, software, source code, algorithms, AI models, educational materials, and documentation on this Platform are the exclusive intellectual property of Seeken AI and are protected under UAE Federal Law No. 38 of 2021 on Copyrights and Neighbouring Rights, international copyright treaties, and applicable intellectual property laws.

• You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Platform content without prior written authorization
• The Seeken AI name, logo, and associated marks are registered trademarks. Unauthorized use constitutes trademark infringement
• Any content you submit to the Platform grants Seeken AI a non-exclusive, worldwide, royalty-free license to use, process, and display such content for the purpose of providing the Services
• You retain ownership of your original User Content, subject to the license granted above

Responses, recommendations, and educational content provided by our AI assistant are for informational and educational purposes only. Important disclaimers:

• AI-generated content does not constitute professional, legal, medical, financial, or certified educational advice
• While we strive for accuracy, Seeken AI does not guarantee the completeness, correctness, reliability, or timeliness of AI-generated content
• Users should independently verify important information before relying on it
• AI outputs may contain errors, biases, or outdated information. Use critical judgment at all times
• Seeken AI is not responsible for decisions made based on AI-generated content
• AI-generated content does not replace qualified human instruction or professional consultation

We are committed to protecting your privacy in compliance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL) and its implementing regulations. Key provisions:

• Personal data is collected and processed only for specified, explicit, and legitimate purposes
• We implement appropriate technical and organizational security measures to protect personal data
• Personal data is not transferred outside the UAE without adequate safeguards as required by the PDPL
• Users have the right to access, correct, delete, and restrict processing of their personal data
• We do not sell, rent, or trade personal information to third parties for marketing purposes
• Data retention periods are limited to what is necessary for the purposes of processing
• In the event of a data breach, affected users and the UAE Data Office will be notified as required by law

You are responsible for maintaining the confidentiality and security of your account. You agree to:

• Use strong, unique passwords and enable multi-factor authentication where available
• Never share your login credentials with any third party
• Immediately notify Seeken AI of any unauthorized access to or use of your account
• Log out of your account after each session, especially on shared devices
• Not attempt to access other users' accounts or personal data
• Keep your contact information accurate and up to date

You are solely responsible for all activities that occur under your account. Seeken AI shall not be liable for any loss or damage arising from your failure to secure your account credentials.

• The Platform may contain links to or integrate with third-party websites, services, or APIs
• Seeken AI does not endorse, control, or assume responsibility for third-party content, policies, or practices
• Your interaction with third-party services is governed by their own terms and privacy policies
• Seeken AI is not liable for any damage or loss caused by third-party services
• We strongly advise reviewing the terms and privacy policies of any third-party service before use

If any paid features or subscriptions are offered through the Platform:

• All prices are displayed in the applicable currency and include VAT where required under UAE Federal Decree-Law No. 8 of 2017
• Payments are processed through secure, PCI-DSS compliant payment gateways
• Seeken AI does not store credit card numbers or sensitive payment information on its servers
• Refund requests must be submitted within the applicable refund period as specified at the time of purchase
• Seeken AI reserves the right to modify pricing with prior notice to users
• Chargebacks initiated fraudulently may result in account termination and legal action

The Platform and all Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding the accuracy, reliability, or completeness of any content
• Warranties that the Platform will be uninterrupted, error-free, secure, or free from viruses
• Warranties that defects will be corrected or that the Platform will meet your specific requirements

Seeken AI expressly disclaims all warranties to the maximum extent permitted under UAE law.

To the fullest extent permitted by applicable UAE law:

• Seeken AI, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages
• This includes, without limitation, damages for loss of profits, goodwill, data, business opportunities, or other intangible losses
• Our total aggregate liability for any claims arising from or relating to the use of the Platform shall not exceed the amount paid by you to Seeken AI in the twelve (12) months preceding the claim
• The limitations apply regardless of whether the damages arise from breach of contract, tort (including negligence), strict liability, or any other legal theory
• Seeken AI is not liable for damages resulting from unauthorized access to your account, data breaches caused by your negligence, or reliance on AI-generated content

You agree to indemnify, defend, and hold harmless Seeken AI, its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use or misuse of the Platform or Services
• Your violation of these Terms or any applicable law
• Your violation of any rights of a third party, including intellectual property rights
• Any content you submit, post, or transmit through the Platform
• Any fraudulent, deceptive, or illegal activity conducted through your account
• Any claim that your User Content caused damage to a third party

Seeken AI reserves the right to, at its sole discretion and without prior notice:

• Suspend or terminate your account and access to the Platform for violation of these Terms
• Remove or disable content that violates these Terms or applicable law
• Report suspected criminal activity to UAE law enforcement authorities, including the UAE Cybercrime Prosecution
• Cooperate with law enforcement investigations and legal proceedings
• Preserve and disclose information as required by law or legal process

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, indemnification, limitation of liability, and governing law) shall continue in full force and effect.

In accordance with UAE Federal Decree-Law No. 34 of 2021 on Combating Rumours and Cybercrimes:

• Any suspected cybercrime, fraud, or unauthorized access will be reported to the relevant UAE authorities
• Users found engaging in prohibited activities may face criminal prosecution under UAE law, which carries severe penalties including fines and imprisonment
• Seeken AI maintains comprehensive audit logs and cooperates fully with law enforcement investigations
• Penalties under UAE cybercrime law include fines ranging from AED 100,000 to AED 3,000,000 and imprisonment of up to 15 years for serious offences
• Users may report security concerns or suspicious activities to: Dhruvan@seekenai.com

Seeken AI shall not be held liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of God, war, terrorism, pandemics, government actions, sanctions, power failures, internet or telecommunications outages, cyberattacks, or any other force majeure event.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

These Terms, together with our Privacy Policy and any other legal notices or agreements published on the Platform, constitute the entire agreement between you and Seeken AI regarding your use of the Platform. These Terms supersede all prior agreements, representations, and understandings, whether written or oral.

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates.

• Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation between the parties
• If negotiation fails, disputes shall be submitted to mediation administered by a mutually agreed mediator in the UAE
• If mediation is unsuccessful, disputes shall be resolved by the competent courts of the United Arab Emirates
• The language of all proceedings shall be English and/or Arabic as determined by the applicable court
• Nothing in this section prevents Seeken AI from seeking injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information

Seeken AI reserves the right to modify, update, or replace these Terms at any time. Changes will be effective upon posting to the Platform with an updated "Last Updated" date. Material changes may be notified through email or a prominent notice on the Platform.

Continued use of the Platform after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically. If you do not agree with the updated Terms, you must discontinue use of the Platform immediately.
